The Senate is one week from August recess, the President is demanding they stay in town, and a growing number of Republican senators say they won’t vote to leave. Samara Brown explains what’s actually blocking the SAVE America Act — and the two procedural paths that could still get it through.
Brown is Senior Policy Advisor at the Center for Renewing America. She spent over four years in Senator Ted Cruz’s office as his Domestic Policy Advisor and eight years total on Capitol Hill, where she personally argued Byrd rule challenges before the Senate parliamentarian. This is the segment where that experience shows.
The week on the Hill: the funeral services for the late Senator Lindsey Graham. The Fauci hearing before Rand Paul’s Homeland Security and Governmental Affairs Committee, where the former NIH director invoked the Fifth Amendment rather than answer questions about the diary entries Paul released days earlier — despite holding a preemptive pardon. And the fight consuming everything else: the SAVE America Act.
Then Brown walks through the mechanics, and it’s the clearest fifteen minutes you’ll find on this.
Path one: the talking filibuster. Hold the floor. Make the minority stand up on C-SPAN and explain to the country why they won’t vote for it. She points to the 1960s Civil Rights Act fight, when the floor stayed open for over a month — and argues that’s when actual negotiating happens, the horse trading people now sneer at as backroom dealing.
Path two: overrule the parliamentarian. Brown’s argument is that the parliamentarian’s role is advisory, not constitutional and not elected. If she rules a provision violates the Byrd rule, a simple majority of 51 can overrule the chair. She calls it the easier path, and acknowledges it would break precedent.

She argues Republicans have supplied Democrats the votes to break filibusters when the roles were reversed and have never gotten the favor returned, and that the filibuster has already been changed repeatedly — the cloture rule didn’t exist before 1917, the threshold moved from 67 to 60, and both parties carved out nominations in 2013 and 2017.
