But the confrontation is already escalating. Hochul and James have now sued the Rensselaer County Sheriff’s Office after Sheriff Kyle Bourgault refused to terminate his county’s longstanding 287(g) agreement with ICE. The state is asking a court to force the sheriff’s office to comply.
The battle sets up a major federalism and public-safety showdown: Can New York prohibit independently elected sheriffs from participating in a federal immigration enforcement program authorized by Congress?
