The defense asks Judge William Sullivan to enter a finding of not guilty based on lack of criminal responsibility. What would the defense need to establish for the judge to grant that request?
⚖️ MOTION TO DISMISS ON DOUBLE JEOPARDY GROUNDS
Clancy’s attorneys argue the mistrial should not have been declared under these circumstances and that a second trial should be barred. We’ll explain their argument and the question of “manifest necessity.”
📱 HOLDOUT JUROR’S PHONE RECORDS AND QUESTIONNAIRE
The defense seeks records and a limited inquiry into the holdout juror’s answers during jury selection and alleged cellphone use during deliberations. These are allegations and requests, not findings of misconduct.
📅 WILL THERE BE ANOTHER TRIAL?
We’ll follow any announcement from prosecutors about a retrial and any scheduling decisions from the court.
SCHEDULING UPDATE: The prosecution and defense agreed to postpone the juror-inquiry motion to give the juror’s counsel time to respond, subject to the judge’s approval. We’ll cover its status and explain the pending requests. Not every motion will necessarily be argued or decided today.
Clancy’s first trial ended in a mistrial after the jury deadlocked, reportedly 11–1 in favor of finding her not guilty by reason of lack of criminal responsibility. No unanimous verdict was reached.
