Georgia prosecutors are at the center of two major legal battles involving elections, judges, and allegations of bias.
Fulton County District Attorney Fani Willis previously indicated that she and other metro Atlanta prosecutors planned to challenge a new Georgia law changing certain local elections — including district attorney races — from partisan to nonpartisan contests. But when the lawsuit was actually filed, Willis was NOT a plaintiff.
Instead, DeKalb County District Attorney Sherry Boston filed the challenge against the State of Georgia in her own name. Willis publicly supported the effort and appeared alongside Boston when the legal challenge was announced, but Boston ultimately became the sole named plaintiff.
The law, signed by Gov. Brian Kemp, affects several major metro Atlanta counties, including Fulton and DeKalb, and is scheduled to change affected elections beginning in 2028. The lawsuit argues that selectively imposing nonpartisan elections in those counties violates the Georgia Constitution.
Now Sherry Boston is involved in another extraordinary legal confrontation.
Boston is asking DeKalb County Superior Court Judge Yolanda C. Parker-Smith to recuse herself from criminal cases and other matters involving the District Attorney’s Office, accusing the judge of “bias and prejudice” against Boston and her prosecutors.
The motion comes after an investigative panel of Georgia’s Judicial Qualifications Commission found reasonable cause to believe Parker-Smith committed judicial misconduct.
Among the allegations cited by investigators: an attorney was allegedly jailed after arriving late because of conflicting court appearances; Parker-Smith allegedly threatened to jail an assistant district attorney who was out of the country on approved leave; and the judge allegedly refused to enter her courtroom for the return of a 2026 grand jury indictment because she did not want an assigned sheriff’s corporal in the courtroom.
The investigative panel concluded that the alleged conduct warranted discipline and could constitute “willful misconduct in office” and conduct “prejudicial to the administration of justice.”
Boston argues the situation has now created a fundamental problem for criminal cases before Parker-Smith because members of the DA’s staff could become witnesses in disciplinary proceedings involving the judge.
