Attorney Kurt Nacht, who is not involved in the case, questioned what could possibly be contained in the disputed material that makes the administration willing to continue this legal battle. He also expressed skepticism that Judge White would agree to halt enforcement of her own order.
The city argues that immediately restoring the Inspector General’s access could cause “irreparable harm” because the OIG could gain access to attorney-client privileged, private or otherwise legally protected information before an appellate court has an opportunity to review the case.
But Judge White’s written ruling was sharply critical of the city’s position. She concluded that the record showed a developing pattern by the city to “delay, diffuse, and deny” OIG subpoenas and rejected the administration’s arguments against what it has repeatedly characterized as the Inspector General’s “unfettered access.”
This fight has been building for months.
Mayor Scott’s administration restricted Inspector General Isabel Cumming’s access to city records earlier this year, triggering a major legal battle over the independence and investigative authority of Baltimore’s Office of Inspector General. Cumming’s office is responsible for investigating potential fraud, waste and abuse inside city government.
The Scott administration has argued that safeguards are necessary to protect privileged and sensitive information. The OIG has maintained that direct access to city records is essential for an independent watchdog to conduct investigations without interference.
Judge White ultimately sided substantially with the Inspector General, affirming the OIG’s subpoena authority and ordering the city to restore access.
Now the fight is moving to the next level.
The Scott administration has filed an appeal and wants Judge White to freeze enforcement while that appeal moves forward. If White refuses, the administration says it will seek relief from a higher Maryland court.
