One of the most striking developments: defense attorney Ashley Merchant, who played a key role in exposing the romantic relationship between Fani Willis and special prosecutor Nathan Wade, has chosen NOT to seek reimbursement at all — a move that shuts down any attempt to retaliate against her through fee litigation.

Other filings raise eyebrow-raising details, including claims from attorneys who were also defendants seeking compensation for time spent defending themselves, and affidavits describing tense, belligerent interactions with Nathan Wade during the prosecution.

Fani Willis’s entire proposed 2026 budget is roughly $39 million. With fee claims already approaching half of that amount, Fulton County officials are openly admitting that taxpayers — not the DA’s office — may be forced to cover the bill, potentially through cuts to other services or even property tax increases.

Willis has now filed a motion attempting to re-enter the case to oppose the fee awards, despite having been removed. Defendants argue the law does not allow her to intervene. The decision now rests with Scott McAfee, who must determine whether the fees are reasonable, who pays them, and whether Willis has any legal standing left at all.

This statute has never been tested before, meaning the outcome could reshape prosecutorial accountability in Georgia — and set a precedent nationwide.
