Kevin Reddington is escalating his battle with the lone holdout juror from the Lindsay Clancy murder trial.
The defense has filed a new motion asking Judge William Sullivan to authorize an investigation into “Juror Doe,” publicly identified after the mistrial as Michael P. Desronvil.
Reddington is asking the court to preserve juror records, produce Desronvil’s confidential juror questionnaire and related records, and conduct a limited inquiry into whether he answered questions truthfully during jury selection.
The defense also wants records connected to Desronvil’s cellphone use during deliberations and is seeking an independent examination into whether he used his phone or received outside information while the jury was considering Lindsay Clancy’s case.
Reddington wants Desronvil questioned about his voir dire answers, statements he made to the court during the final days of deliberations, his cellphone use, and whether any outside information influenced his decision.
IMPORTANT: Judge Sullivan has NOT granted the defense’s request for an inquiry at this time. Reddington is asking the court to take these actions, and the allegations contained in the motion have not been established as findings of juror misconduct.
Desronvil has publicly defended his decision, saying he had “no doubts” and believed the physical evidence, witness testimony and prosecution’s case established that Lindsay Clancy knew what she was doing and planned her actions.
His attorney, Edward Andrew Paltzik, has also publicly defended his client and argued that jurors must be allowed to follow the evidence and the law without fear of retaliation.
Meanwhile, Reddington is pursuing another major legal strategy that could potentially prevent Lindsay Clancy from ever facing a second trial.
The defense has filed additional arguments supporting its effort to obtain a required finding of not guilty and is also challenging whether another prosecution can proceed following the mistrial.
The case returns to court September 29.
